Hialeah teen accused of killing his mother speaks during virtual court hearing

MIAMI (WSVN) — A 15-year-old teenager charged in the fatal stabbing of his mother appeared in court virtually on Tuesday.

Derek Rosa, who was 13 when he was accused of killing his mother more than two years ago, appeared before the judge, who asked whether he was doing OK with his defense team.

“If you have any difficulty with your lawyers, or you feel that they’re not doing what they’re required to do, and you want me to know about it, please tell them to bring that to you,” Judge Richard Hersch said.

The exchange came weeks after one of Rosa’s defense attorneys withdrew from the case. Rosa told the judge he had no concerns about his legal representation.

“Your Honor, I would prefer if Ms. Dayliset would speak for me because I trust her with my thoughts,” Rosa said.

Judge Hersch said he would soon decide whether Rosa needs a competency evaluation.

“I am concerned whether I need to order up a competency determination of your client,” Hersch said. “I will address that on [January] 23rd, unto any objections to this court doing so.”

Police said Irnia Garcia was stabbed more than 40 times while she slept in her bedroom at their Hialeah apartment in 2023. Her newborn baby, who was nearby, was not harmed. Investigators said Rosa called 911 and confessed to the crime.

Prosecutors have suggested Rosa may have been influenced by violent horror movies such as “Friday the 13th,” a claim his defense team has rejected.

Rosa has pleaded not guilty. Although his attorneys requested additional time to prepare, the judge said the case will move forward, with trial scheduled for Jan. 26.
