TALLAHASSEE, Fla. — Florida homeowners’ associations (HOAs) may see new fees if a recently filed bill is approved, potentially taking effect in July 2026.
State Sen. Ileana Garcia (R-Miami) filed SB 906 on Monday, which proposes the creation of a state Office of the HOA Ombudsman. This office would assist community association members in understanding their rights and responsibilities, while also monitoring HOA meetings, elections, and dispute procedures.
SB 906 would also expand the powers of the Division of Florida Condominiums, Timeshares, and Mobile Homes, allowing it to better oversee HOA compliance with state regulations.
A linked bill, SB 908, would impose a new annual fee on HOAs. Associations with more than two parcels would be required to pay $4 per residential parcel to the division. If the fee is not paid by March 1, the HOA would incur a 10% penalty. The bill notes that associations deemed delinquent would lose standing in state courts until all fees and penalties are paid.
If both bills are passed during the 2026 legislative session, the changes would become effective July 1, 2026.
