Homestead Detective Uncovers Domestic Violence After Woman’s Hospital Visit

HOMESTEAD, Fla. — A 49-year-old man was in custody Thursday in Miami-Dade County after hospital staff suspected a woman who claimed she had fallen was actually a domestic violence victim, police said.

The woman sought treatment at Baptist Health Homestead Hospital, saying she had fallen down the stairs. Staff reported their suspicions, prompting an investigation.

According to a police report, officers accused David Pena, a Puerto Rico native living in Homestead, of assaulting the woman he has been married to for eight years.

“She was scared to tell police the truth,” a police officer wrote in a report about the August 31 domestic violence incident.

The woman later told a Homestead detective that during a heated argument over infidelity, Pena armed himself with a candle holder, spit at her, and “grabbed her by the neck,” according to the arrest report.

Detectives documented text messages Pena sent to the victim after the incident, including one saying, “All this can go away, but it’s up to you. Just don’t report anything,” the police report stated.

Pena faced charges of domestic battery by strangulation, aggravated assault with a deadly weapon, and tampering with a witness. His bond was set at $4,000.
